TERMS OF SERVICE

By accessing or using the Luxe Club LLC (d/b/a “Luxe Club Co”) website (“Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

USE OF THE SITE

You must be at least 18 years old and legally eligible to participate in competitions offered on the Site. Use of the Site for any unlawful purpose is prohibited.

COMPETITIONS & OFFICIAL RULES

Participation in any competition constitutes acceptance of the applicable Official Rules. In the event of a conflict between the Official Rules and these Terms of Service, the Official Rules govern.

PURCHASES & ENTRIES

Entries may be obtained through optional purchases or through a free Alternative Method of Entry (“AMOE”). No purchase is required to enter or win, and making a purchase will not increase the chances of winning. Additional details about the AMOE are available on the designated AMOE page and are incorporated into these Terms. 

PAYMENT PROCESSING

Payments are processed by third-party providers. Luxe Club Co does not store full payment card details and is not responsible for payment processor errors outside its reasonable control.

INTELLECTUAL PROPERTY

All content on the Site, including text, images, logos, and design elements, is the property of Luxe Club Co and may not be used without prior written consent.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Luxe Club Co shall not be liable for any indirect, incidental, or consequential damages arising from use of the Site or participation in competitions.

DISPUTES

Any disputes arising from use of the Site or participation in competitions shall be governed by the laws of the State of New York, without regard to conflict-of-law principles.

SITE AVAILABILITY

Luxe Club Co does not guarantee uninterrupted or error-free operation of the Site and is not responsible for technical issues beyond reasonable control.

TERMINATION

We reserve the right to suspend or terminate access to the Site for violations of these Terms or applicable laws.

CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Site constitutes acceptance of the updated Terms.

SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.

REFUNDS, CANCELLATIONS & CHARGEBACKS

All entry purchases are final.

By purchasing an entry into any Luxe Club Co competition, you acknowledge and agree that your payment secures one or more entries into a promotional competition and does not constitute the purchase of the featured item.

Because entries are immediately recorded and counted toward the maximum entry limit for a competition, purchases cannot be canceled, refunded, returned, or transferred once submitted.

Refunds will only be issued in the following circumstances:

    •    Duplicate transactions

    •    Verified technical errors resulting in overcharge

    •    Cancellation of the competition by Luxe Club Co

    •    Where required by applicable law

If a competition is canceled for any reason, all paid entries for that competition will be fully refunded to the original payment method.

Customers are encouraged to contact Luxe Club Co to resolve any billing concerns prior to initiating a chargeback or payment dispute. Unauthorized or fraudulent disputes may result in account review or restriction, consistent with applicable law.

By completing a purchase, you agree not to initiate a chargeback or payment dispute except in cases of genuine fraud or billing error.

LAWFUL SWEEPSTAKES

All promotions offered through the Site are intended to operate as lawful promotional sweepstakes. Payments made are for promotional participation and related offerings, and do not constitute wagers or gambling activities.
